Introduction

HowToWritePrompt.in ("we", "our", "us") respects the intellectual property rights of others and expects users of our Platform to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act of 1998 ("DMCA").

Note: Submitting a false DMCA notice is a serious legal matter. Knowingly making a false claim of infringement may result in liability for damages, including costs and attorney's fees.

What Is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a framework for online service providers and copyright owners to address claims of copyright infringement online. It provides a "safe harbour" for service providers that promptly respond to takedown notices.

Even though our Platform is based in India, we voluntarily follow DMCA procedures as a best practice for handling copyright complaints globally, in addition to complying with applicable Indian copyright law (Copyright Act, 1957).

How to File a Takedown Notice

If you believe content on HowToWritePrompt.in infringes your copyright, please send a written DMCA takedown notice to our designated agent via email:

Notice Requirements

To be valid, your DMCA notice must include all of the following:

Your Identity

Your full legal name, email address, physical address, and phone number. If acting on behalf of an organisation, include your title and the organisation's name.

Identification of the Copyrighted Work

A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.

URL of Infringing Content

The exact URL(s) on HowToWritePrompt.in where the allegedly infringing material is located. "It's somewhere on your site" is insufficient.

Good Faith Statement

A statement that you have a good faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.

Accuracy Statement

A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

Electronic or Physical Signature

Your physical or electronic signature (typing your full name in the email body is acceptable as an electronic signature).

Notices missing any of the above elements may be rejected or significantly delayed while we request the missing information.

Our Response Process

Once we receive a complete and valid DMCA notice:

Acknowledgement: We will acknowledge receipt within 24 hours
Review: Our team will review the notice for completeness and validity
Action: If valid, we will remove or disable access to the content within 48 hours
Notification: We will notify the user who posted the content that it has been removed
Counter-notice: The user will have the opportunity to file a counter-notice (see Section 6)

We aim to action all valid DMCA notices within 24–48 hours of receipt, Monday through Friday.

Counter-Notice Procedure

If you believe your content was removed in error, you may submit a counter-notice to admin@howtowriteprompt.in. Your counter-notice must include:

Your full name, email, physical address, and phone number
Identification of the content that was removed and its original URL
A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
A statement that you consent to jurisdiction of the Federal District Court for your judicial district, or if outside the US, any judicial district in which HowToWritePrompt.in may be found
Your physical or electronic signature

If we receive a valid counter-notice, we may restore the content within 10–14 business days, unless the original complainant files a court action to restrain restoration.

Repeat Infringer Policy

In accordance with the DMCA and our Terms & Conditions, we maintain a policy to terminate, in appropriate circumstances, the accounts of users who are found to be repeat infringers of copyright.

A user who has had content removed following three or more valid DMCA notices may have their account permanently terminated without prior notice.

Misuse & Abuse Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be held liable for damages — including costs and attorney's fees.

We reserve the right to pursue legal action against parties who submit false, fraudulent, or abusive DMCA notices targeting legitimate content or users of our Platform.
